Participation in the competition is only possible in accordance with these competition conditions. By entering the competition, you agree to be bound by the following competition terms and conditions.
1. Competition and organiser
1.1 From 14.02.2022, 08:00 hrs to 14.02.2022, 23:59 hrs, karlanders GmbH is organising a competition on Instagram.
A total of 14 NFTs will be raffled off under the name "Krypto Karls Vol.1: Love, Karl Anders Love Stefan Mosebach". In the competition, the participant must perform the following actions during the competition period in order to participate:
The participant must tag the NFT (the post) they would like to win and their "favourite Valentines date".
Each participant can enter as many times as they wish. Each participant can only win a maximum of one NFT.
The 14 winners will be selected by drawing lots. In the event that a duplicate name appears among the selected 14 winners, a new draw will be held in that case.
After determining the 14 winners, karlanders GmbH will contact the 14 winners and transfer the NFT to the winners' wallet.
The NFT will be sent to the winners' wallets by 1 March at the latest.
2 Eligible participants
2.1 Natural persons who are resident in the Federal Republic of Germany and have reached the age of 18 are eligible to participate. Employees of karlanders GmbH and their direct relatives are excluded from participation.
2.2 Participation is only possible in one's own name. Participation with forged identities or with identities of third parties is not permitted. There is no entitlement to a substitute cash payment.
3. Conditions of participation, determination of winners and prize distribution
3.1 In the event of a breach of these conditions of participation, the participant may be excluded from participation in the competition.
3.2 Persons who provide false information in the context of the prize draw, use unauthorised aids or otherwise obtain advantages through manipulation (e.g. through computer programmes, so-called "bots", which automatically enable participation) will also be excluded. In these cases, the refusal of an already promised prize and also the reclaiming of the prize are possible.
The claim to the prize is not transferable. If a period of five days for claiming the prize expires, the claim to the prize shall lapse.
3.3 Participation is free of charge and independent of the purchase of products or the subscription to a newsletter.
3.4 The draw will be made at random. Two days after the end of the competition, karlanders GmbH will randomly select 14 winners from the participants and inform them exclusively by personal message on the social media platform. The respective winner himself/herself is responsible for checking his/her inbox. Upon receipt of the prize notification, the winner is obliged to inform the organiser of the receipt of the prize notification and his/her wallet address. Thereafter, the NFT will be sent to the winner's Wallet no later than 01.03.2022. If the winner does not confirm receipt of the prize notification and provide his/her specific Wallet address within five days, the claim to the prize will lapse.
4 Cash payment, exchange, prohibition of assignment
4.1 Cash payment of non-cash prizes is not possible. The same applies to any exchange. Consequently, the winner or other participants have no claims to cash payment or exchange.
4.2 The winner's claim to the prize cannot be assigned. There is no entitlement to a substitute cash payment.
5. Termination/modification/suspension of the competition
The Promoter may modify, suspend or terminate the competition itself at any time without prior notice and without giving any reason, insofar as this is necessary due to circumstances beyond the Promoter's control or if this is the only way to ensure the proper conduct of the competition. If such termination is caused by the conduct of an entrant, the Promoter shall be entitled to claim compensation from that person for any loss suffered.
6. Exclusions of liability
6.1 karlanders GmbH accepts no liability for technical difficulties in the transmission of the NFTs.
7.Exclusion of liability for participant entries
7.1 Participants undertake to behave in a legally compliant manner when commenting on the competition entry, i.e. in particular not to make any insults or false statements of fact or to infringe intellectual property rights.
7.2 If a participant violates this obligation and a third party asserts claims or rights against the organiser as a result of the violation, the respective participant is obliged to indemnify the organiser against these claims/rights as well as any related legal costs.
8. Data protection
8.1 The competitions are not connected with any social network, namely Instagram, and are in no way sponsored, supported or organised by them. The recipient of the information provided by the entrant is not Instagram or any other social network, but karlanders GmbH. Instagram or any other social network is not responsible for any of the content published as part of this promotion. The liability of Instagram or any other social network in connection with this promotion is excluded. karlanders GmbH shall indemnify Instagram against any justified claims by third parties in connection with this competition. All questions, comments or complaints about the competition should be addressed directly to the organiser and not to Instagram.
8.2 The personal data collected from you as part of the competitions will only be processed for the purpose of administering the competitions. The data will be deleted after the end of the competitions, at the latest on 31.03.2022. The data processing for the implementation of the sweepstakes is based on your consent in accordance with Art. 6 Paragraph 1 Sentence 1 lit a) DSGVO. You have the right to revoke your consent to the processing of data at any time with effect for the future. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation. 9. Exclusion of legal recourse and choice of law
9.1 Legal recourse is excluded. This does not apply with regard to questions of data protection law.
9.2 The law of the Federal Republic of Germany is exclusively applicable.
10. Miscellaneous
These conditions of participation constitute the final regulations for the competition. Should individual provisions of these conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.
